Terms of use
These terms are a license agreement between you and Camden Burke (“the developer”) for the ConfettiYeti app (“the app”). By downloading or using the app you agree to them. If you downloaded the app from the Mac App Store, Apple's Standard End User License Agreement also applies, and where these terms and Apple's disagree, Apple's govern the points it covers.
1. License
The developer grants you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service, including use by family members through Family Sharing where the purchase allows it. The app is licensed, not sold. You may not copy, modify, reverse engineer, rent, lease, sublicense or distribute the app, except where the law allows it despite this restriction.
2. ConfettiYeti Pro
- ConfettiYeti is free to download. ConfettiYeti Pro is an optional one-time purchase made through the App Store. It is not a subscription and does not renew.
- Pro unlocks the features shown on the Pro tab in Settings. You can preview them before buying.
- You can restore a purchase at any time with Restore Purchases in Settings, on any Mac signed in with the same Apple Account. Payment, refunds and billing are handled by Apple under its own terms.
- Features may be added, improved or changed in future updates.
3. Using the app safely
- The app draws moving effects over your screen. It is designed without strobing or hard flashes and respects the macOS Reduce Motion setting. If you or anyone watching is sensitive to motion or flashing images, leave Reduce Motion on and avoid using it.
- The app can fire automatically (for example when a meeting ends). Use Pause, the daily limit and “Skip while presenting” so that it never interrupts a presentation or call. You are responsible for how and when you trigger it.
4. Permissions and your data
The app asks for Calendar or Reminders access only if you switch on a feature that needs it, and keeps everything on your Mac. See the privacy policy.
5. Ownership
The app, its name, artwork, sounds and code belong to the developer. You own your preferences and anything you create with the app. These terms give you no rights in the developer's trademarks.
6. No warranty
The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent the law allows. In the event of any failure of the app to conform to a warranty that cannot be excluded, you may notify Apple, and Apple will refund the purchase price for the app if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
7. Limit of liability
To the fullest extent the law allows, the developer is not liable for indirect, incidental, special or consequential damages, or for lost data, profits or opportunities, arising from your use of the app. The developer's total liability for any claim is limited to the amount you paid for the app. Nothing here limits liability that the law does not allow to be limited.
8. Apple
You and the developer acknowledge that these terms are between you and the developer only, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for claims relating to it, including product liability, legal or regulatory compliance, consumer protection, or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you as a third-party beneficiary. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
9. Ending the license
The license ends automatically if you break these terms. You can end it at any time by deleting the app. Sections that by their nature should survive (ownership, no warranty, limit of liability) do.
10. Governing law
These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of laws rules, except where your local consumer law requires otherwise.
